Legal Question in Family Law in Pennsylvania
Can I keep insurance and prove infidelity
My husband of 1 year wants a divorce. In this one year he had a female ''friend'' who I suspected he was cheating with through rumors but he denies. Do I need proof of this affair and how do I get it if they both deny it? Also I will be losing medical coverage after the divorce and me job does not offer it. Can I have it put in the divorce that he will continue covering me for x number of years after the divorce? I was told that was possible because I have a disease that was diagnosed during the marriage that needs daily medication or can kill me.

Re: Can I keep insurance and prove infidelity
Proof of an affair is not necessary; but it could be useful. If they deny the affair you can try to gather evidence to show it existed. It could help with post-divorce alimony, though your health problems would probably be more important. Your health insurance coverage would be an important issue and a judge would be likely to want to make some provision for it. It is impossible to guess what that arrangement might be because it would depend upon the other assets and liabilities in your marital estate.
