Legal Question in Family Law in Pennsylvania

Jurisdiciton change?

Divorce orignated in FL. Joint legal with me being CP.

Was approved by FL court for relocation with children to PA.

Have been here 10 months.

Can I file to have case moved here?

Since there is a 1000 miles between us, and he is not active in girls lives, can I file for sole custody?

Child support being pursued by FL as he has not paid in almost two years.

Re: Jurisdiction change?

Once you have been in Pennsylvania for 6 months then you could file a custody action in Pennsylvania. That said you need to look at the court order allowing you to move. What you are looking for is to see if the Florida court retained continuing jurisdiction. If it did you might first have to seek the courts permission to file in Pennsylvania.

If you have any questions feel free to contact me. The initial consultation is free.
