If your husband is abusive, whether physically or mentally, you are free to leave him. Your first stop, however, should be to the Family Court and obtain a Protection from Abuse Order from the Court. This will prevent him from coming close to you and making any threats. If he does, he will have violated a Court Order and will be guilty of Contempt of a Court Order for which the Judge can incarcerate him for up to 6 months.
You should also go directly to the Family Court Clerk's Office and file a Petition for support for yourself and for the children.
