Legal Question in Family Law in Pennsylvania

leaving

I want to leave my husband. We live in Philadelphia, own a home and have two minor children. I have asked him to leave and he won't so if i were to take my children and move into an apartment would he be able to go to court and take my children because i abandoned him?

Your situation is dependent on many factors to numerous to discuss here. Family law matters are also fact sensitive. If you leave with the children either you or your husband could file a petition for custody. It would be up to the court to decide what is in the best interest of the children regarding custody.
