Re: leaving the state

First, do you have a custody order? If you do what does it say about relocation of the children?

If it says nothing he can ask for a hearing on whether you can take the children out of state.

If there is not a custody order you should get one.

If you have any questions feel free to contact me. The initial consultation is free.

If you are going to relocate with the child out of the state, you need to file a petition to modify the custody order (if there is one) and a petition requesting court permission to relocate. Otherwise, he could file a petition to get an order having the child returned to PA.

It is complicated, and I would recommend you consult an attorney. I offer a free 1/2 consult at one of my 6 office locations.
