legal guardianship of a handicap person

my mothers will said i would take care of my handicap brother if i could not my sister would is this enough proof for me to be his legal guardian

no you still have to request that the court give you legal guardianship. If there is no contest and the judge weighs the pros and cons in you receiving guardianship then you will probable get the guardianship, however, you should always consult with a professional and have them guide you through the process.
