There is no such thing as legal separation in Pennsylvania. In Pennsylvania a date of separation is established as the date the parties ceased to cohabit. There are 2 elements of cohabitation. One the parties live together and two they engage in marital relations. If either element is not met then the parities are not cohabitating.

There is no "process" of separation in Pennsylvania, as such, and what you need to do to protect yourself and secure your interests is going to depend heavily on the particular facts of your situation, and on your goals. First and foremost, your best bet is to sit down with a family law attorney for an hour or so, to let him or her put the rug back under your feet. This becomes even more important if there are children involved. There is no need for you to jump blind into the next phase of your life, but there is far more to address than a single question format like this has any hope to achieve.

That said, my web site features a short article offering some suggestions to people facing separation, that may offer you some of what you are seeking:

The advice given here is accurate. many times once the parties actually separate they enter into a separation agreement which spell out various economic and other issues involving the parties. Many times this can be used to resolve most if not all issues should the parties follow through with divorce proceedings. it would be well worth your time to consult with an attoreny further about your particular situation as each situation is different. if you would like to consult with my office feel free to call to schedule an appointment.
