Legal Question in Family Law in Pennsylvania
Am I liable for husbands mortgage on house that is his, not ours?
1 Answer from Attorneys
If you did not sign the mortgage documents, you are not liable to the mortgage company. Also, if the house is in his name only, and you claim no interest in it, you cannot be liable for his debt as part of equitable distribution. Rather, a likely outcome will merely be your agreeing that you have no interest in the house and you walk away from it.
However, if the house was acquired after you were married, but merely put in his name, it is marital. Then the mortgage would also be marital. As a practical matter, mortgages generally only effect the property and are not personal obligations, anyway.
