Legal Question in Family Law in Pennsylvania

I lived with my kids father for 11 years we recently decided to break up he just bought a house about 3 months ago but its only under his name can he kick me and our kids out of the house would i be able to do something about it

Attorney Segan is correct. You do not provide enough information. For example, are you married to the kids' father? If not, you have no marital rights to the real property unless your name is on the deed. And if you are not married, yes, he can kick you out. He still has to support his children though. Leave - find a friend or relative or go to a shelter and file for child support.

If you are married, the ball game changes. Then you are entitled to a share in the real property, regardless of how it is titled as well as to other marital assets. It will be best for you to speak with a family law attorney who can review your specific situation and advise you as to your marital rights, if any, and the children's right to support.

Actually your relationship may go back far enough to predate the Commonwealth Court decision that said Common Law marriages formed after 2004 would no longer be valid,

So if you were living as man and wife and holding yourself out as a couple. You might be able to claim there was a common law marriage. It's a stretch.
