Legal Question in Family Law in Pennsylvania

I am located in PA. I have a PFA against my wife because she broke my sons leg. I want a divorce. She is not willing to sign anything. She is making my life hell due to her own screw up. I have filed for full custody for all 4 of my children. The PFA is good for 3 years. She she has been ordered to stay away please tell me that I can get a simple divorce.

I cannot tell you that. If she will not voluntarily agree to a mutual, "no fault" divorce, you may have to wait two (2) years for a unilateral divorce. That's just Pennsylvania law. You may be able to obtain a "fault" divorce in a shorter amount of time, however, but these are more and more uncommon anymore.

I strongly suggest that you sit down and consult with a family law attorney to go over all of your possible options. If you'd like to discuss your situation further, feel free to contact me offline. Best of luck to you and your children!

Simple divorces are conspicuous by their rarity. What you do need is caring and sympathetic attorney. I believe I match those qualities plus 38 years of experience in two states.
