Legal Question in Family Law in Pennsylvania

If a man and wife has lived together in a household with 2 children for 3 years, and they decide to split up, can the woman move to a different state and file for custody in this new state only after living there 5 months?

Under most circumstances, no. The statute requires six months of residency before a state can have jurisdiction. However, if it has been five months and you challenged jurisdiction, she would be able to file in a month anyhow..
