Legal Question in Family Law in Pennsylvania
My marriage has not been good for several years. My husband drank too much in the past. He does things just to hurt me or make me angry. He is either very happy or very sad at home. Mostly very sad. He really does not do things with our family. He has become quite the loner. He does work hard and provides for us. We have two children in college. I have been having an affair with a man who I am in love with. I want to leave my husband, but I am scared how he will react. I honestly think he needs help. I have suggested that to him. I have told him that since we are both unhappy we should split up, but he gets angry at the thought, even though he has many times told me he hates me and his life. He has never ever physically hurt me. I don't want him to find out about the affiar because I don't want to hurt him and also I don't want that to be the focus.... our marriage is not bad because of the affairl It was done years before the affair. There would never have been an affair if it had been good. We have a house that we still have a mortgage on. We have a rental property that I inherited. I was laid off my job and have found a new job that I would like to take over an hour away. I do get unemployment now. I have found an apartment that I could afford and still make payments on the car that I drive, but would not be able to pay towards the house bills. I would like him to stay in our house and pay all the bills on it until it sells (it is not up for sell yet) and I move out. He can afford to do it on his own. How do I go about doing that? How should I handle it? I know once I tell him that I will have to leave immediately. He says if I leave he is changing the locks and I can't get anything. Can he do that? Will I still get half when the house sells? Do we really have to live apart for two years before the divorce unless there is a fault? I don't want my affair to be the fault. We have not shared a bed in several years. Thank you for your help.

The best way to handle this is to consult with an attorney in person. It sounds as though you want to end the marriage. In that case its better to be proactive then wait for your husband to take action.
