Married Filing Seperate

My Spouse is paying Child Support for a child born from an affair and owes some arrers.

My spouse received a letter stating that Income tax may be intercepted when filed. It also stated that if filing a joint return the other person can file an innocent spouse form.

I can't afford for out entire income tax to be intercepted (which my portion will eventally be returned), so can i file married filing seperatly and claim our child.

Is that leagl to do, so that I can avoid mine being intercepted for a period of time

It is best to consult with an accountant but it seems to me you do not have to file a joint return with your spouse.
