Married in PA, living in NJ, Might need a divorce
My wife threw me out of the house. I got married to her in PA but now we live in
NJ. Do we file in NJ?

If you have lived in and are residents of NJ you need to file there.

Hi,
It isn't important where you married, it is where you live. In order to file for divorce the residency requirement is one (1) year in New Jersey. If the grounds for divorce is adultery you can file immediately without living in New Jersey for a year. The law absolutely requires that you or your spouse has been a resident for the stated period of time immediately prior to and at the time that you file for a divorce. For example, you cannot have lived in New Jersey for six months before moving to Nebraska for another six months and then come back to New Jersey to file for a divorce. However, after you have filed, you can move anywhere in the world.

The correct answer is that you absolutely positively need to speak to an attorney before you do anything. Period. 'threw you out'? you have important decisions to make, and you need some expert advice. and you need it now. please, please do not try to 'work it out' and do it on your own. I can not tell you how many people come to me and cry about how they were terribly tricked by their spouse and/or did not know what they were doing.
Find an experienced attorney who spends a large part of his/her time handling divorces. Find someone fairly close to you. Pay the attorney for a consultation, and spend an hour getting some clear guidance.
