Legal Question in Family Law in Pennsylvania

Hi My name is Matt and i get my 2 son's every Tuesday and Thursday's overnight and every other weekend. The Mom and I live in the same school district. My question is that my 13 yr old son had said that he would like to live with me. I was wondering how old does a child have to be in the state of PA to be able to make a choice on which Parent they would like to live with. Either one of us has Custody and it's just between us. Thanks.

There is no magic age. The statute says one of the factors is,"The well-reasoned preference of the child, based on the child's maturity and judgment." Since it sounds like mom doesn't agree you'd need to go to court to change the custody arrangement.
