Medical Insurance

Earlier this year I filed for Spousal Support that included Medical/Dental/Medicine/Eye coverage. My husband fought the findings and the Spusal Support was turned to APL. Insurance was not negotiated during this hearing. His attorney stated that it was what ever the orginial findings were through Spousal Support.

I am now having problems since he has not updated his childrens information. As of this date no one, including the children have insurance. Since he is the only one that can get information or provide it, I don't feel safe with him controlling my insurance with me having medical problems. I am planning on looking for my own insurance that I know I am covered.

Am I able to return to Domestic Relations and have changes made to the insurance information or must I remain on his until a separation/divorce is completed?

As of this time we are still legally married.

I see no reason that you can not go back to get the insurance issue resolved. Assuming that your and the children were insured prior to the separation the coverage should have been continued. In addition they should have determined how uninsured expenses would be split.

Coverage for the children should be in the child support order.
