minor child leaving out of state to live with mother

Hi, I'm taking my daughter to live with me in the Seattle are but her father lives in Philadelphia. Both of us never had to go for custody hearing. We were together for ten years and now I'm trying to move on. He said he will write a notorized letter allowing our daughter to live with me out of state. But it seems like he's not going to do this. Can I still take my daughter with me without this letter? I know he won't be able to take care of her. We have our tickets and set to go in a month but I know want to go to court delaying our move. So in summary can I take my child without this letter?

Whether you have a letter or not he can drag you back to PA for a hearing on whether you can move with your daughter.

Of course if there is a letter his case is much weaker.
