Legal Question in Family Law in Pennsylvania

My minor son is a beneficiary to my deceased aunt's retirement fund. The insurance company says that in order to claim the money, I have to establish guardianship with the county court. Why do I need to do this if I am the birth mother? Should I hire an attorney? I reside in PA

If they say you have to do it or they won't give you the money than it looks like you don't have much of a choice. That said I bet you it wasn't the insurance company's lawyer that said that. So find yourself a lawyer who handles estates and guardian ships and see if he agrees. If he does ask him if he'll do the required paperwork.

It is required because the funds belong to the child....usually, they do not want a parent to be the legal guardian for that purpose. It is not an extensive or expensive proceeding.
