Legal Question in Family Law in Pennsylvania

Modification for Child Custody and child Support

My ex husband and I had a martial agreement which he started to renege on. For instance, the amount of child support granted for me, times to visit the kids. He also claimed the kids on last year tax return and they lived with me through all of 2006. This caused me to have my tax returned on hold till the IRS reply to situation. We recently went to court because I tried to get a restraining order which his lawyer got the judge to continue till April 13. I believe that his lawyer just bought him time to push the custody hearing so that the restraining will not be held over his head. I don not have a lawyer and I feel his lawyer will eat me alive. We currently have joint custody (3 year old twin boys). They are to move in with him next year till they are ready to go into 6th. Then they come back to me till 9th. I want to change the joint custody to me having partial parenting so the kids primarily stay with me and the father gets holidays and summers. I also have a job waiting for me in PA and I currently live in Florida. I have to move by April 1 and he just got served with a summons on Feb 28. I want to just move and file everything over in the state of P A. What should I do?

Re: Modification for Child Custody and child Support

Where is you husband and children? In Florida or PA? Also you can get an attorney and attempt to have the legal bills paid for by your husband. Go to an attorney where you are located and speak with him or her about this.

Re: Modification for Child Custody and child Support

You have a lot of issues and many of them are complex. You should strongly consider retaining an attorney to represent you especially if you feel his attorney "will eat you alive".
