mother's rights

Husband and I are fighting and he won't let me take our baby out of the house. He puts our child over my head saying I can't take her without his permission. What can I do to get legal papers saying I can take her any time I want even though not divorced.

You asked about a mother's right to a child.

You need no legal paper stating that you have a right to travel with a child. The only time you would need ANYTHING is if you were to attempt to leave the country with a child under a certain age. The child is legally in the custody of both the mother and father and until a court issues a custodial order otherwise either parent may exercise complete custody and control of the child to the exclusion of the other parent. (Though doing so would be a recipe for disaster unless there were particular circumstances.)

My suggestion is that you speak with the counselors at a local women's shelter or family law clinic.
