A Mother's rights Question

I had a son he's now almost 13 yrs. old. My husbandand I, his step father have raised him since he was born I never filed for paternity I don't want to know. This guy that I had been dating and broke up with a month before he would have been concieved is now working with my husband and actually told him that he wanted us to take him for a DNA test. We don't want any disruptions in our family. My son is aware he has another father and doesn't care he only knows the one who has raised him all along. What rights do I have as his mother, his only parent list on his birth certificiate from this ass trying to do anything?

You asked about an interloper seeking a paternity test.

You will need to consult with an attorney to handle this matter.

In order for a potential father to question paternity there must be some substantial basis for doing so. The fact that the interloper waited for thirteen years would give a judge almost conclusive cause to deny the interloper's request for a paternity test. The law is usually loathe to disturb a strong family.

You may also consider pre-emptive maneuvers. If this person continues to make comments at work the co-worker could file a harassment claim with the employer's compliance or legal office. You may also consider obtaining a restraining order against this person.

(It doesn't need to be said, but your husband's first inclination to kick the ass of this idiot should not be pursued.)
