If you are not married to the person you have no rights in connection with a divorce. If you have a child with the man, you can sue him for child support. Contact your local domestic relations office in the county where you and the child reside and seek to get a support order established.

If he does not pay the mortgage, then eventually the lender is going to foreclose on the home and when the property is sold you will have to leave. So what do you want to do?

If money is tight, stay in the home as long as you can and save up. Where else can you live rent free?

If you can afford it and want the home, get your fiance to convey his interest in the home to you and refinance it in your name solely.

Is there any equity in the home? You could try to sell and split any equity but your fiance would either have to give you a power of attorney to handle the sale or he and you would both have to agree.
