Moving my child out of state

I want to move out of state with my 4 year old child. The father has court ordered visitation rights. He has threatened me and my fiancee repeatedly. He comes to my house all the time causing disruption. he has been abusive physically in the past. I really need to get away from him. Can I legally move out of the state of Pennsylvania?

In order to relocate out of state, you will have to file a petition to modify the current order, as well as a special petition, seeking court permission to relocate. There are a number of factors that the court must take into consdieration in deciding whether the child can be moved out of state. If you move out of state without court permission, or his written agreement, then the father can file an emergency petition seeking an order that the child be returned to PA.
