Legal Question in Family Law in Pennsylvania

moving out of state

I am a custodial parent. I was offered a job in Colorado. Can I legally move out there with my 8 year old daughter?

Re: moving out of state

You can move but the non custodial parent is entitled to a hearing on whether the move is in the best interest of the child. The child's father could waive the hearing but if he doesn't then the court examines the move by using the Gruber Factors.

Its boils down to will the custodial parent and hence the child be better off financially? Is there some way to allow the non-custodial parent to maintain contact with the child? Those are the 2 major tests. There are more factors but those are the big ones.

If you have any questions feel free to contact me, the initial consultation is free.

Based on what you say it looks possible you could move.
