Legal Question in Family Law in Pennsylvania

moving within the state of pa

I am recently devoriced; the marital home is up for sale. I would like to relocate for better job and educational opportunities and to reduce stress on myself and our children. My ex is very difficult to deal with. Our two older children (ages 17 and 14) refuse to maintain a weekly visitation schedule with my exhusband and my younger child(age 10) doesn't want to visit regularly with out them. I would like to know if I can relocate with in the state of Pa and how far away can move. My ex states I can not leave I town I live in until the children are 18. He has move about twenty minutes away from our marital residency. I feel that to restrict me to the town I live in would be like holding me hostage.

Re: moving within the state of pa

You are best off getting a modification that allows you to move and also reduces the visitation the ex receives to match what is happening now. With the ages of the children being what they are, you should prevail. I offer free consultations.

You have to obtain court permission to relocate. A petition requesting permission would have to be filed, as well as a modification petition. It sounds like you have a basis for doing so. Free consultation available.
