moving within the state

My son's dad and I are not married,we don't have a formal custody agreement, as we have been amicable with each other. Now, I'd like to move 300 miles away to get a better job and better life for my son and me. My ex's new girlfriend is trying to keep me (by influencing him ) from moving. If I move out here, can he file for custody where we lived to have us come back? Or should I file first? Where do I file...where I used to live or where I might be moving?

Re: moving within the state

The rules of civil procedure dictate where you need to file. If the move is within the state you probably should move and then file. If the move is out of state you will need to wait to establish residency. You should consult an attorney.
