Legal Question in Family Law in Pennsylvania

Moving On

My wife filed a non-fault divorce over two years ago but now refuses to sign the papers.(I have signed) We still live together because I am keeping the house and she will not move out. We do not live as man and wife. I am eager to get on with my life. Does separation time apply because we have not slept together in over two years? Can she change the divorce to a ''fault'' divorce because she filed? (she is threating to do so)

Re: Moving On

If the divorce was filed and served over two years ago, then you can move it forward. I would proceed with the divorce on the basis of a two year separation and get it finalized. If her name is on the house and she will not sign it over, then you may have to go to court to get that resolved. Please contact me to discuss further.
