Legal Question in Family Law in Pennsylvania
newborn custody laws
I am 8 months pregnant. My husband is emotionally abusive and has an alcohol problem, and a past drug problem. He is consistantly walking out on me and says he is going to file for divorce and take custody of our unborn child. What rights do i have as a mother in custody of a newborn baby. I want to be able to have full custody of the baby for as long as I can because I fear the lifestyle he will take our newborn into, as well as i want to breastfeed and not bottle feed. Are there special provisions for custody when a baby is a newborn.

Re: newborn custody laws
The courts will take all that into account when determining custody. They decide based on the best interests of the child. From what you've said above, it is very unlikely that they would give the father primary custody. However, they may still give him visitation rights.
