non-marital equitable distribution time frame

When it comes to non-marital equitable distribution in Pa. is the increase in property value based on from the time of marriage to seperation or from the time of marriage to divorce? My husband had property prior to us getting married. We married in 1992 and seperated in 2002. I filed for divorce in May of 2004. The property value has increased enourmously in the past few years. Up to what time am I entitled to a portion of the increasement in value since our marriage?

Re: non-marital equitable distribution time frame

The Pennsylvania Divorce Code includes in the definition of marital property �the increase in value, prior to the date of final separation, of any nonmarital property�. Determining the date of final separation, however, may be a factual question open to argument.
