Legal Question in Family Law in Pennsylvania

Pa common law marriage

Lived with a woman for 20 yrs, broke up and she moved out. I think PA did away with common law marriage about 6-8 yrs ago. Can woman come back and sue me for anything I own ? House we lived in was left to me by my father, we never purchased anything jointly.

Re: Pa common law marriage

Common Law Marriage was out in 2004. After which new common law marriages were no longer recognized. Common law marriages prior to that still our recognized. Though proving common law marriage is not easy. Then she'd have to file for a divorce to get equitable distribution.

Given your facts the house would not be part of the marital estate. So even IF she could prove a common law marriage existed and divorced you the house would not be subject to equitable distribution.

If you have any questions feel free to contact me. The initial consultation is free.
