if i make a paper for my daughter father to sign for him to bring her back certain date... it a contract.. its valid

If its valid then what? How do you enforce it?

Based on what you have said I take it that you and dad aren't living together. That fact alone indicates that a whatever custody arrangement you and dad come up with needs to be made into a custody order that will be enforced by the courts.

If you haven't got a custody order in place you need to get one. To do that you need to file a custody petition. If you already have physical custody but no order you need to file a petition to confirm custody.
