The father of my child has all but raised our son because i was not able to. I have been involved in my son life and see him on weekends and whenever time i can. The problem is neither one of us has legal custody, and his father wants and is movig to Florida. I do not want to loose my son now after finally having him in my life again. Can he take him out of state without my permisson since neither one of us has legal custody? And if he does can i get him for kidnapping?

Parents have natural custodial rights to children that must be modified by a court to prevent the action of moving out of state. You should file for custody and request an order preventing the move out of state.
