Parental Rights

My son was just informed that he has a son. The baby is 2 1/2 years old. We were just informed of this last week. Do we have any rights to this child? and what is involved in getting rights to this child? My son's name is not on the baby's birth certificate and has not had a DNA test. The mother continues to threaten to take the baby and we will not see him anymore.

Your son, as the baby's natural father, has parental rights to the child. In order to claim these rights he will have to file a custody petition. If contested, paternity will be established through the appropriate testing.

While it is possible to take these actions without an attorney by directly contacting the Domestic Relations Division of the Court of Common Pleas in the child's home county, it is much better to contact an experienced domestic relations lawyer in your area so that your son may be fully aware of his legal rights and obligations as a parent, and may be guided in the legal process. If there is a true imminent danger of the child being removed from the jurisdiction to avoid your son's rights, your attorney may file to have your hearing expedited or heard on an emergency basis.
