parental rights

my step childrens mother contacted us asking about giving up her parental rights. the children where all living with her until 10 months ago. she had become homeless and gave the kids to us. he now has sole legal and primary physical custody. she has talked to them 30 minutes a week by telephone since january. she has not seen them since october even though she is allowed an hour suppervised every month. she says she wants to give up her rights because she can't do this anymore. she also has a 2 month old baby who she says is sick and she says that she is sick and in the hospital all the time. my questions are if she gives up her rights can she change her mind later? also would it be better or easier if she agreed right away to let me adopt them, father and i have been married for alomost 5 years? what do we do to get this done?

Re: parental rights

For her to give up her parental rights some has to adopt them. In this case that would be you. As a result your husband would be the adoptive father of his children. Though no one other than a family lawyer would think of that.

They way it happens you file to adopt the children. Mom signs a voluntary termination of parental rights. Then there are 2 hearings held back to back. The termination hearing and then the adoption hearing. 30 days after those hearings neither birth parent can change their mind.
