Paternity

Are there any laws that restrict a mother from giving her new born baby the last name of it's father, even though the mother and father are not married.

No. Under PA law every person is to have a first and a last name. There are some minor exception but that has to do with celebrities like Cher.

If you name the father on the birth certificate he could challenge paternity.
