Legal Question in Family Law in Pennsylvania

Paternity

In PA, can i get a court ordered paternity test done if the woman is still legally married? Also, what recourse do I have if I know the expecting mother is actively using marijuana?

Re: Paternity

Depends on who she's married to. If its not you then the answer is NO. The presumption is that if a married woman get pregnant the husband is the father unless he's impotent,or in jail or overseas on military duty such that it would be impossible for him to be the father. However, you have no standing to ask for a paternity test.

I suppose the allegation could be reported, however, you might want to consider the long term consequences of such a report, especially if it comes back unfounded.
