i took out a payday loan 6 yr ago signed both my and spouses name to agreement and check payed it back, spouse knew shortley after and benifited from the money, now during divorce is thretning me with forgery and other charges is this possable

Yes very possible. You did in fact forge his name by your admission. Unless you have a "Power Of Attorney" you are not permitted to sign in his name.
