Who pays for what?

My boyfriend is seperated from his wife for almost 2 yrs. divorce procedings have not taken place as of yet. They own a home together which his wife lived in. He pays support for 2 children. Yesterday the house burned down (thank heaven all are ok) no insurance and she is also a few months behind on the mortgage. My question is who is responsible for late and future payments of the house and clean up as the house was destroyed? We just arent sure what will happen next. Thank You for any advice.

In the event of a divorce, Pennsylvania law provides for equitable distribution of all marital assets. Marital assets are defined as property acquired from the date of marriage to the date of separation. That includes any increase in value of what was premarital property.

If there is a loss, and neither the husband nor wife are at fault, there are simply less assets. However, they are likely both still liable to the mortgage company.
