Legal Question in Family Law in Pennsylvania

I am in Pennsylvania. I've been married for almost a year. My wife has moved in with a friend of hers, and is not willing to sign anything. She plans to leave the country next month. She's filipina and it was a fast international marriage. Can I file for divorce without her written consent?

You can always file for divorce. If she doesn't consent you can obtain the divorce on other grounds.

If you have any questions feel free to contact me. The initial consultation is free.

Her consent is not needed to file a divorce complaint. A consent divorce cannot be completed until after the ninety day waiting period has expired from the date of service of the divorce complaint. If she won't sign the consents after the ninety day period, you will have to wait until 2 years of separation has occured, at which time the 3301d affidavit can be filed.

I would suggest that you retain an attorney. If she would leave the country service of the various documents may become difficult and she may need served via alternative methods.

If you don't already have an attorney, feel free to give me a call. The initial consultation is free.
