Legal Question in Family Law in Pennsylvania
pension rights
my soon to be ex was enrolled in a pension plan for 4 yrs at the time of our seperation. He is 100% vested. He received a projected benefit at retirement statement which
said if he retires in 2009 he is entitled to 1200/monthly.
Am I entitled to any of that at settlement and how is that
calculated?

Re: pension rights
You are entitled to the portion of the pension that was earned during the marriage. That is you take the number of months you were married and divide that by the number of months he was in the pension. That is the coverture fraction. That is the portion of the pension that is marital property. How much of that you get depends on the other assets that are marital property and how the marital property is to be divided.
I would need more information than what you have given.
