Are Possessions is 90% of the law?

My nephew 33 yrs old was killed in a car accident, he has one surviving daughter 12 yrs old whom lives with her mother. My nephew was unmarried and had no will. At the time of his death , he was living with a women for 5 months. He was not on the lease agreement. His girlfriend has refused to give any of his property to his family , including his daughter. My question is ; is there any law that would support the actions of this girlfriend.

My sistor has aquired a lawyer and was given admistrator of his estate, although as of this date, no belongings have been returned. 2 months have passed from his death and now they are seeking a court order. What type of defense could protect this girlfriend other than common law ? Thank you for your time in this matter .

the law does not protect the girlfriend, she is nothing but a common thief
