Legal Question in Family Law in Pennsylvania

post divorce property settlement agreement

I divorced my husband on 5/16/03 through a no-fault proceeding. He was supposed to sign the Property Settlement Agreement, but at the last minute, did not send it in. He had promised to sell our jointly owned home but has been stalling. He had made my life a living hell through acts of verbal abuse and getting my 12 yr old son to punch me when I resided in my home. We were all residing in the home together after the divorce. The situation with the violent acts by my son became too dangerous for me and my 2 daughters to continue to live there, so I was forced out of my own home. Before I could even move my personal belongings out, my ex changed the locls and refuses to let me even get my clothes and my daughters belongings. Could you tell me how I can facilitate a post divorce settlement agreement pro se ? Or if I can get an attorney who will accept payment when the home is sold, since I have at least $30,000 in equity and possibly more if I count the antique cars that he owns. Any help would be greatly appreciated since I am now living in a small, expensive apartment with my 2 daughters. He also expects me to continue to pay half the mortgage and the taxes even though I am locked out of my home.

Re: post divorce property settlement agreement

You have every legal right to live in the house. If he refuses entry you can bring an action to force entry and also to partition the property, whihc would lead to a sale. I would be happy to discuss payment on a continguency basis.
