Legal Question in Family Law in Pennsylvania

Praecipe to Register Custody Order from another state

My husband will be traveling from Pennsylvania (where we live) to Arkansas to go to a hearing where custody of his minor child will be granted to him. I understand that for Pennsylvania to recognize this order it will have to be ''registered''. Does this entail a formal legal filing or is it sufficient to go to the prothonotary's office and ''register'' the document? Will this enable me to get him into school, etc? An attorney said that she would have to file a ''Praecipe to Register''. Is this necessary? I'm really trying to cut costs as much as possible.

Re: Praecipe to Register Custody Order from another state

Assuming he has a valid order from Arkansas it should be recognized in a Pennsylvania court. As well as being valid for any other purpose.

I suppose you could register it. But why. For example supposing he was living in Arkansas and was awarded custody. Then for some reason that would not allow the other parent to challenge his right to relocate to Pennsylvania. He and the child move to Pennsylvania. There would be no cause to register anything. Nor would there be given the facts you've given to me.

Once the child lives here 6 months Pennsylvania would have jurisdiction unless the order state Arkansas retains jurisdiction for custody matters.

Bottom Line: I don't see where registering it is required.
