Legal Question in Family Law in Pennsylvania

protection from abuse or restraining order

My husband and I are separated. He has just been diagnosed with bi-polar disorder &the dr is changing his medication. he has a history of exhibiting verbally abusive and progressively physically abusive behavior towards me when his meds are changed (no legal history though). to protect my 21 mo child and myself (I'm 8wks pregnant), should I attempt to get a restraining order or a protection from abuse. I had a confrontation with him last night and felt verbally abused and threatened by his words & behavior. I don't have an attorney yet, although I'm working on it today. My plans potentially include a divorce. Can you explain the difference between the 2 orders and make a recommendation for my next move? Thank you!

A PFA order is a type of restraining order. It is issued on a temporary basis until a hearing is held on the merits. The hearing is held within 10 days of its issuance. If the allegations are proven, a permanent order valid for 1 year is issued. If you have been threatened than filing for a PFA is appropriate. I oofer free consultations.

A Protection from Abuse Petition (PFA) would provide greater protection and immediate relief than through divorce proceedings. The length of a PFA is actually up to 18 months. It sounds from what you describe that this is the preferred option. Please contact me if you wish to further discuss.
