Legal Question in Family Law in Pennsylvania

I dont know how to put this...?

My fiance has had his daughter from november first, 39 days out of 180. Do we have a good leg to stand on. Considering she comes back here a mess. IE Colds, rashes, dirty, smelly.

Also the day before we were supposed to go to court, his lawyer got himself removed as counsel. Esq. claimed that he would be a witness to an agreement never made by my fiance. Is that even against the code of the bar?

Re: custody rights

The standard for awarding custody in this state is the best interests of the child. Based upon the other parent's conduct, it seems clear to me that the best interests of the child might be served by your fiance' having primary physical custody. Is there an Order for custody in place?
