qdro

Divorce granted Mar 2004. County court ordered a QDRO to give half of retirement and pension to me. Both my attorney & his failed to come up with a Qdro. Ex husband has passed away in June. What do I do now to get a Qdro before his estate takes everything out of his pension & Retirement?

You have to file a petition with family court for a Qdro. Your attorney should know how to do this.

I do not know the impact of the death on this process.

Before you assume his estate gets the retirement check to see if you weren't a beneficiary.

You may have even more of his retirement than the QDRO might have given you.

There's no guaranty that you get anything due to his death but it cost so little to ask.

Otherwise you'll have to get a QDRO against the estate.
