Legal Question in Family Law in Pennsylvania

Qdro

I was divorced in November of 2004. I recently contacted my divorce lawyer to get a copy of my QDRO because I never received a copy of it. My divorce lawyer hasn't answered any of my correspondence. My suspicion is that she never followed through and filed one. It states on my divorce decree that she was suppose to file one and I did get charged for her supposedly working on it. What will happen if she never filed one? Will I still be entitled to my ex husband's pension benefits? And, also what can I do to that law firm if she didn't file one?

Thank you

Re: Qdro

You must immediately protect yourself. You still have rights to the pension; but they can change dramatically if your ex get married, dies or retires. Go to the Prothonotary and look at your divorce file. See if the QDRO is there. If not you must immediately retain another attorney to protect your interest. Don't wait.

If they did not follow through you might be able to require them to pay your new attorney.
