Legal Question in Family Law in Pennsylvania
I have a question regarding the right to representation. I have a Custody Hearing coming up in 2 weeks. I currently have representation. However her inability to handle the case has become apparent. Therefore I'm concerned having her represent me in the case. I'd like to obtain the representation of another attorney however due to the holiday's and the fact that I want to make sure my next attorney is capable of handling the case, I'm short on funds and feel I would need more then 2 weeks to obtain good representation...I definitely do not want to represent myself. My question is if I request a continuance due to no representation, can the Judge deny the continuance and proceed with the hearing? If I do have the right to representation, is there a PA Statute that I can reference?

I would not wait until the last minute to ask for a continuance. I am not sure what type of hearing you have. The court can deny it and order you to proceed. You must also consult the other side for their position on a continuance. If you hire a new attorney, and that person has a conflict with the court date, that may be helpful. Please note that many of custody cases do not involve attorneys.
