quit claim deeds?

I have an ex who is on my mortgage and deed but has not lived there for over a year, I have invested money in this house and I am now going to sell, I have custody of our 4 children and want to use the money from the sale of my house to help purchase a new house. I have pretty much always paid the mortgage, he never had a real job. He has agreed to sign off for $2,000 if I give it to him now but I don't want him to be able to show up at closing and walk away with my money and screw me over. How do I safegurad myself?

Well, maybe not a quit-claim deed; but that would probably be ok. You should have him transfer his interest in the house to you for the $2,000.00. This means he signs a deed. I'd go for a general warranty deed. He should also sign a short agreement or a release making clear that he has no further marital claims. Check with your lawyer in the divorce about whether there are any open claims.
