Real Property Ownership

Please advise on how to get real property transferred to one spouse. Is there a form Transfer of Property to One Spouse that can be utilized? The real property has been purchased; however, neither party has lived at the residence. No money was paid down on property, only the wife's money to renovate it. The wife wants to reside at the residence.

You will need to utilize some form of deed to transfer the property. While many people rely on quit claim deeds my preference for my clients is to utilize general waranty deeds. The form you file in the recorder of deeds office will allow you to identify the marital relationship of the parties and therefore should reduce the property transfer tax. Have a new deed prepared transferring the property from husband and wife to wife. Have it signed in front of a Notary Public by both and then file it in the recorder of deeds office.
